This Terms of Service Agreement (the "Agreement") is entered into between Your Growth Consultant Limited T A Luubu (hereinafter referred to as "Company") with its principal place of business at 20 Townleys Road, Rd 1, Dunedin, 9076, and the user (hereinafter referred to as "User").

1. Acceptance of Terms

1.1 By accessing or using any services provided by the Company, the User agrees to be boundby the terms and conditions set forth in this Agreement.

1.2 If the User does not agree to these terms and conditions, they should not access or use any services provided by the Company.

2. Services

2.1 The Company offers marketing software services to assist businesses in achieving growth and success.

2.2 The Company will make reasonable efforts to ensure the availability, accuracy, and efficiency of the services provided.

2.3 The User acknowledges that the Company may modify or discontinue any part of the services at any time without prior notice.

3. User Responsibilities

3.1 The User agrees to provide accurate and up-to-date information to the Company when using their services.

3.2 The User is solely responsible for maintaining the security and confidentiality of their account credentials and agrees not to share them with any third party.

3.3 The User agrees not to use the Company's services for any illegal, unauthorised, or prohibited purposes.

4. Intellectual Property

4.1 All intellectual property rights, including but not limited to copyrights, trademarks, tradesecrets, and patents, related to the Company's services and software shall remain the exclusive property of the Company.

4.2 The User agrees not to reproduce, modify, distribute, or create derivative works based on the Company's services or software without the Company's prior written consent.

5. Limitation of Liability

5.1 The Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Company's services.

5.2 The User agrees to indemnify and hold the Company, its officers, directors, employees, and agents harmless from any claims or demands, including reasonable attorney's fees, made by any third party due to or arising out of the User's breach of this Agreement.

6. Governing Law

6.1 This Agreement shall be governed by and construed in accordance with the laws of New Zealand.

6.2 Any dispute arising out of or in connection with this Agreement shall be settled by arbitration in accordance with the rules of NZIAC or by filing a lawsuit in the appropriate court of New Zealand.

7. Severability

7.1 If any provision of this Agreement is held to be invalid or unenforceable, the validity and enforceability of the remaining provisions shall not be affected.

Our marketing software allows users to receive messages regarding marketing trends, tips, and promotions to help grow their business.

You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
